In the midst of your pain and suffering from an accident caused by a rideshare driver, you’ll still need to think about all the logistical details of your injury claim. It may not seem fair, but without appropriate paperwork and evidence, your claim is not likely to prevail.

Fortunately, a skilled and reputable personal injury attorney can make sure your paperwork and evidence are meticulously prepared, filed and organized.

Filing An Accident Report

If you fail to report your accident by filing an accident report with the rideshare company, it will be much more difficult for you to make an insurance claim for injuries from that accident. That will be true regardless of whether you were hit by a rideshare driver or hit while a rideshare passenger.

If you have any of the following evidence, you should submit it with the accident report:

  • Pictures of the accident scene
  • Pictures of both vehicles
  • A copy of any document(s) the police gave you
  • Pictures of your injuries, if you have any visible injuries
  • The names and contact information of any independent witnesses (i.e., anyone not involved in the accident who saw it happen)

What Happens Next?

The rideshare driver’s insurance company should get back to you shortly with the results of their investigation. If an attorney does not represent you, they are likely to deny your injury claim or make a minimal offer to settle your claim.

It’s worth noting that insurance companies do not respect claims brought by people who are without legal representation. They know they can generally ignore your claim unless and until you get an attorney.

If Your Accident Claim Is Denied

If Uber or Lyft denies your accident claim, your only recourse is to contact an attorney. The appeal procedures, such as they are, are entirely controlled by the insurance company. You are highly unlikely to be able to make any progress without an attorney. Your only recourse is to file a lawsuit, and you’ll need an attorney for that.

Avoid Making Admissions

When filing an accident report, don’t admit to anything unless you’re 100% sure. For example, if you’re not clear about how the accident happened, don’t say you were at fault just because the other driver insists you were. Stick to the facts, and stick to what you can remember clearly.
