Bring with you any documents you have from the accident itself, including:

  • The police report if the police gave you a copy at the accident scene
  • Driver exchange information, including identifying insurance information
  • Your driver license
  • Your auto insurance card
  • Health insurance, Medicare or Medicaid cards
  • Medical records and information for any medical treatment you’ve already received

How Will You Handle Communication With Me Throughout The Case?

Communication can make a huge difference while seeking compensation. The best lawyers also tend to have the best communication because they keep you updated on the progress of the case.

They’ll be in frequent contact with you in the early stages of the case because there is a lot that needs to be handled.

There are three things that are important and ensure the best chance of success for your case:

  • First, participate in your medical treatment to the extent that it helps you. It is important that you engage in medical treatment, such as is necessary for you, not what you think is suitable for the case. If the medical treatment is not helping you, you should discuss this with your attorney and discontinue that treatment.
  • Please keep your attorney updated on changes to your contact information, such as your email address or phone number.
  • You should also let your attorney know if you begin going to a different or new medical provider or if you have stopped going to your medical treatment.

What Should I Do If I Have Questions Or Concerns During My Case?

You should always feel free to reach out to your attorney and call them or speak with someone from their office for any questions or concerns you have about your case. If you attempt to reach your attorney several times and they don’t return your calls or respond to your emails, or you’re only able to speak with staff, you should consider whether you want to continue retaining that attorney.

One of the primary roles of an attorney is not only to advocate for their client but also to provide advice and educate their client on the nature of the legal proceedings they’re involved in. So, if you do have questions, take them to the attorney, and if the attorney does not adequately respond to you, then consider your ongoing representation.

It’s challenging to evaluate an attorney from the outside, especially as a lay client with no legal experience. It can be difficult to determine who’s the best attorney. The attorneys with the largest, flashiest offices are not necessarily the best advocates. So, important questions to ask are generally centered around the attorney’s experience.

Some of the questions you should ask include:

  • What is your experience with handling personal injury cases?
  • How long have you practiced law?
  • How many cases similar to mine have you handled?
  • How much litigation and trial experience do you have?
  • How often do you or your office communicate with clients, and how responsive are you to client contact?
  • What are the strong and potential weak points of my injury claim?

What Might The Potential Outcomes Of My Case Be, And What Realistic Expectations Should I Have?

Every case is different and has its own specific factors. I can never give an exact prediction of what an insurance company will say, what a jury might say, or what the actual outcome of the case will be.

Because of my experience, I’ve handled many different types of claims, and I’ve handled many claims with the same insurance companies many times over. Therefore, I’m often able to make a reasonable estimate or an analysis based on the available information.

Based on that, I will try at several points in the case, both from the beginning and as information develops about the severity of an injury, whether more medical treatment is required, and whether we learn more about liability.

Suppose we’re able to obtain a video of the incident claim. In that case, I will keep you apprised as things develop and give you an ongoing estimate of where to end the case in terms of settlement value and what the best tactics would be moving forward, whether that’s trying to settle, proceeding to trial or anything in between.
